If you are reading this, there's a good chance that you or a loved one have been arrested and charged with a DUI/OVI within the last few days.  If that's true, you probably have many questions, concerns, and fears.  You no doubt are worried about the potential penalties and what effect a conviction may have on your ability to drive and get to work or school.  You probably have many questions about whether you can keep your license, on how much your fines and court costs might be, or even if you'll have to display those special license plates for people convicted of OVI.

If it's your first arrest for an OVI, your friends and family have probably already explained that you'll have to do some time in jail or at least attend the Weekend Intervention Program, which costs around $300.00.  You might also be worried about how any jail time you might receive could influence your ability to keep your job.  If your vehicle was impounded, you are probably trying to work out the logistics of getting your vehicle released.  If you had an accident and you damaged your vehicle, you have probably been working out the details of getting that vehicle repaired or replaced with your insurance company.  If you caused an accident and some other person was injured, you should be especially worried about being criminally charged.

If you refused to submit to a breath or blood test, you are probably aware that you will be facing enhanced penalties.  If you hold a special security clearance at Wright-Patterson AFB or drive a truck for a living, you'll know that you can be facing even greater problems.  Finally, if your recent OVI arrest was not your first OVI arrest, you are probably concerned about receiving a longer jail sentence, paying your new "much higher" fines, or of even having the State confiscate your vehicle.

An arrest and charge of OVI, or any other alcohol related offense, is a serious and complicated matter.  Do not make statements to law enforcement officials or to an insurance company.  As you might imagine, time is of the essence in preparing your defense; and you always do have a defense.

People sometimes assume that just because they did drink alcohol, and because they did operate a vehicle after drinking alcohol, that they are guilty of whatever happened after that.  Do not assume that or concede your guilt!  The City/State has the burden of proof to establish a violation of the law.
