The Servicemember's Civil Relief Act of 2003 may play an important role in military family law litigation. A provision that is frequently used is the "stay" provision to stop legal proceedings when military obligations interfere with a soldier's ability to participate in the litigation. In addition, division of a military pension (or retired pay) often is a major issue in these cases. Members of the armed forces must serve for at least 20 years to gain military retired pay. State and federal laws govern how that asset is to be divided and application may vary somewhat between Judges.
