Service of process is when you file official court documents and notify your spouse with them. Service of Process arises from the United States Constitution. Specifically the Due Process language in the Constitution doesn’t allow, “personal jurisdiction over a defendant unless the defendant has proper notice of the court’s proceedings.” This essentially means that the defendant will have to be properly served with the court documents.

These court documents include the Complaint for Divorce, Court Summons and associated pleadings (Financial Affidavit, Parenting Proceeding Affidavit, Family Questionnaire, complaint for Divorce and Title IV-D Application for Child Support Services). Nevertheless, there are specific court rules around this crucial step, and they can vary on where you file for divorce. However, the rules that govern service of process can vary by jurisdiction meaning state or county rules.

domestic violence civil protection order montgomery countyIn the last 4 years in Montgomery County the Montgomery County Domestic Relations Court has cited that they have seen a 40 percent increase in the number of civil protection orders. Anyone, man or woman, can go to court and ask for a civil protection order  from another individual, if they feel threatened or endangered by that individual. There is not a fee involved to file the order, and the person filing can get a hearing immediately. The purpose of the order is to forbid the threatening party from contacting or going near the individual who feels endangered.

Of course there is no guarantee that the civil protection order will keep an individual safe from further harassment or even violence. The Montgomery County Relations Court  is finding that issuing protection orders is consuming greater than half of the entire caseload.  Chief Judge Denise Cross believes that in many cases the protection order serves it’s purpose and as a result the abuser does leave the victim alone. Fraud Alert Notification System (FANS) Can Help Seniors And Homeowners Protect Themselves Against Fraudulent Scams

Fraud Alert Notification SystemUnfortunately, it is not uncommon these days to see a news story on television or read an article in the newspaper or on the internet involving a senior person who has been scammed in one way or another.  One common scam involves fraudulently obtaining ownership of the home of an elderly individual, by either getting him or her to sign a document that he or she doesn’t understand or by fraudulently forging his or her name on a deed.  The wrongful owner then either tries to sell the property or borrows money against it by putting a mortgage on it, leaving the rightful owner with an expensive mess to try to sort out.
