Blast from the past 13 years Ohio Family Law Blog

PUBLISHERS NOTE: More people are executing prenuptial agreements than ever before. Millennials are getting married at a later age, many have a lot of student debt and more assets.  The COVID-19 pandemic is causing people to be more aware of their mortality and planning for the future. I thought reposting this “blast from the past” from June 17, 2017, about prenuptial agreements was appropriate.

Prenuptial Agreements have increased in recent years says study…but why?

prenuptial agreements divorcePrenuptial agreements are daunting to bring up to one’s significant other and many individuals fear bringing up the topic. Many individuals worry that the prenuptial discussion will cause problems, such as making their significant other feel as if they are not trusted or as if there is an anticipation of a divorce in Ohio via a lack of commitment. However, research has shown that having a prenuptial agreement  may in fact strengthen a relationship. Did you know that According to a survey of the American Academy of Matrimonial Lawyers (AAML), 63 percent of divorce attorneys say they’ve seen an increase in prenuptial agreementsrecent years? This is NOT just a male thing either.  Forty-six percent of these lawyers also noted an increase in the number of … Read More... “Blast From The Past: How to Ask for a Prenuptial and Avoid a Break-Up!”

Survey reveals increase in the number of millennials requesting prenuptial agreements in the last three years.

prenuptial agreements millennials divorceIn a previous blog entry, Joseph Balmer discussed the need for antenuptial agreements as an effective, estate planning tool.  In his article, he explained how the mention of the word “prenup” can send a newly-wed-to-be into a frenzy, as such agreements have historically carried a negative connotation and often served as a buzz kill for happily engaged couples.

However, the millennial generation, ages 18-35, seem to be shaking up this archaic way of thinking.

In a recent survey conducted by the American Academy of Matrimonial Lawyers, 51% of the 1600 attorneys surveyed reported an increase in the number of millennials requesting prenups in the last three years. The “prenuptial agreement” is no longer a dirty phrase used by those couples expecting to fail, but rather it has become part of the norm and is viewed as a smart and efficient way to plan for a couple’s future.

Whether it’s because millennials are older when marrying and therefore have more to protect, or because they themselves are often children of divorce and are therefore predisposed to shielding their own interests, this new generation is … Read More... “Prenuptial Agreements Trending with Millennials in Ohio”

Blast From The Past: Hitting The Airwaves With “Big George” On The BBC

Blast from the past 13 years Ohio Family Law Blog

“The experience being interviewed by celebrity “Big George” of the BBC radio in London was really a memorable and fun one! George had read a blog article of mine which he seemed to really enjoy. “Big George” Webley seemed like a cool guy and had a wild wit and great sense of humor. He asked me a couple hilarious questions during the interview which got me laughing. After this episode, I only talked with him 1 other time. Sadely, “Big George” passed away on May 7 2011, at the young age of 53. To the power of the internet and the reach of the Ohio Family Law Blog, I say thank you for creating this blast from the past! May you rest in peace “Big George”.

Prenuptial agreements

England is trying to catch up with Ohio and the rest of the United States when it comes to Family Law.  Until a landmark case last week, the courts in England and Wales put little, if any, weight on the terms of prenuptial agreements.  Prenuptial agreements (also called antenuptial agreements) in one form or another have been around for a very long time.  The Supreme Court of Ohio in 1984 held in Gross v. Gross that, under certain circumstances, they are valid and the terms should be enforced by Ohio courts.

On July 2, 2009, I received an interesting phone call from a journalist from the BBC in London, England.  He wanted to know if I would be interested in commenting on the recent case holding and also sharing some insights about prenuptial agreements from the perspective of an American family law attorney.  I read the decision in the case of Radmacher v. Granatino and agreed to be interviewed a few hours later by “Big George” Wembly, the host of the live ‘Late Show’ on BBC-London radio station 94.9.

After a little research, I learned that “Big George” is an iconic broadcaster in London having had an extensive music career … Read More... “Hitting The Airwaves With “Big George” On The BBC”
