How Gender Of Your Attorney Will Have Very Little Impact On The Final Outcome Of Your Divorce

divorceThere are many factors to consider when selecting your divorce or custody lawyer.  One of the common concerns is whether or not a divorce litigant will be better off having a male or female divorce lawyer representing him or her.  Some people think that if they want an “aggressive” divorce lawyer, they need a male; but if they want someone who is “compassionate,” they should hire a female divorce lawyer.  Should the lawyer be a feisty “take no prisoners” divorce lawyer or does it make sense to have a “nice person” approach in the courtroom?  I’ve heard some men say that they would prefer to have a woman represent them because an aggressive female attorney can soften the harshness of husband’s arguments against his wife.  For example, a male attorney criticizing a wife’s choice not to work outside the home can appear cruel or attacking, but those arguments made by a female attorney could score points in a less offensive manner.

The true answer to this quandary is that there isn’t one personality type or gender that is right for every custody or divorce case.  In my mind, it’s important to find an attorney that you feel will help develop a comprehensive and well-devised litigation strategy for your case. The gender of your attorney should have very little impact on the final outcome of the litigation.  What is important is to select an attorney who is both experienced and one that you feel comfortable with who understands your situation and will present it effectively in Court.  So, in my opinion it’s much more important to hire a divorce lawyer who clearly understands your position, will be industrious working on your case, and returns your calls and emails timely.  There are many good divorce lawyers who are male and good lawyers who are female throughout the Dayton, Ohio area.

Interestingly, statistics show that roughly two-thirds of divorce cases are filed by women.  I believe it is important to have experienced male and female divorce lawyers as options for potential clients.  At Holzfaster, Cecil, McKnight & Mues we have 3 (three) excellent divorce lawyers and custody lawyers to choose from. On staff we have two male lawyers and one female lawyer who do a significant amount of family law work. Each of their experiences and philosophies are different. One has personally gone through a divorce, one just recently became married, and the third has been the publisher of the Ohio Family Law Blog since 2007.

How To Select A Divorce Lawyer

The important thing you should do is interview several potential lawyers and select the one that is the best fit for you.  You should select a divorce lawyer who you are most comfortable with and with whom you are at ease in talking about your case.  One of the first articles on the Ohio Family Law Blog in 2007 was a two-part post about how to select a divorce lawyer.  Here is the link to the first part of the article and here is a link to the final part of the article.  That advice given over 5 years ago still remains true today.

In order to help potential clients preview the personalities of each of the firm’s divorce and custody attorneys at Holzfaster, Cecil, McKnight & Mues, we have uploaded a short video from each.  Here are the links to each of their videos: Robert L. Mues, R. Anne Shale, and Charles W. Morrison.

In addition to viewing each of the attorney’s videos, we have provided a lot of valuable information on our firm’s website.  We’ve also included a signup form there to download a White Paper titled, “Finding Hidden Income/Assets During a Divorce.”
