Ohio Estate Planning

A large percentage of our firm’s practice involves helping individuals and families work through the Ohio estate planning process. Most of the time, Ohio estate planning does not need to be overly complicated. Our Ohio attorneys will help explain Ohio estate planning in an understandable fashion after we have analyzed your specific circumstances and needs. A simple Last Will and Testament along with proper titling of assets may be sufficient or a Last Will and Testament combined with one or more trusts may be appropriate. There are intervivos trusts, testamentary trusts, charitable trusts, Medicaid trusts and special needs trusts. Each person or family’s needs are specific. Also, a proper estate plan should include a general power of attorney, a durable power of attorney for health care and, possibly, a living will. We will discuss with you all of these documents and whether they are appropriate for you.

Our Dayton Ohio attorneys and staff have been serving clients’ Ohio probate and estate administration needs for over 70 years. Properly handling the probate paperwork, filing the necessary estate tax returns, handling and liquidating estate assets, appropriately treating creditors’ claims and working through the intricacies of the estate administration process can be a confusing and overwhelming endeavor. Our attorneys are second to none in providing exemplary services to our clients in this area of Ohio probate and estate administration work.

Ohio Asset Protection

Part of both estate planning and elder law planning involve protecting ones assets to the greatest extent allowed by law. This may involve minimizing one’s potential estate tax liability, protecting one’s estate from beneficiary creditors, and also protecting one’s estate from one’s own creditors. Medicaid planning is one aspect of Ohio asset protection. Life insurance trusts may be another. A special needs trust may be a third. Ohio law now allows one to protect one’s assets from one’s own potential future creditors, as long as no transfer is fraudulent. The Ohio Legacy Trust Act allows a grantor to set up a trust with the grantor’s assets and the grantor as the beneficiary, yet protect it from creditors. Ohio law also now allows a limited liability company’s assets to be shielded from a debtor’s future creditors. Ohio is now one of the most debtor-friendly states in the country. Protecting one’s assets for one’s future needs and one’s children is a primary goal of most clients. We can help ensure that these needs are met.

Ohio Elder Law

Along with estate planning and asset protection, the various legal needs and issues of the elderly have become more and more critical as we all are living longer and have greater health care needs and expenses. Medicaid planning, Medicaid qualifying and asset protection have become more and more commonplace issues. Potential VA benefits or other benefit resources may need to be explored. Gifting options and long-term health care insurance and their part in long-term planning should be considered. Reverse mortgages are sometimes an answer to one’s needs. Nursing home and home-health care issues all fall under the umbrella of elder law. Also, although well drafted powers of attorney usually eliminate the need; if a guardianship needs to be established, we can help walk the guardian through the probate process so that the establishment of the guardianship as well as future accountings are properly handled and completed.
